Understanding Maternity and Parental Leave Rights
20 October 2026 · Global Women's Week
A general overview of how parental leave protections work and questions worth asking your employer.
Parental leave laws and policies vary enormously by country, and within some countries, by employer size and location — there's no single global standard, which makes it worth researching your specific situation rather than assuming a general rule applies to you.
In many places, a distinction exists between job-protected leave (your position must be held for you) and paid leave (whether and how much you're compensated during that time) — these are not the same thing, and a policy can offer one without the other.
Questions worth asking your employer's HR department well before you need the leave: how much leave is job-protected, how much is paid and at what rate, whether short-term disability applies to any portion of it, and how benefits like health insurance are handled during the leave period.
For adoptive parents, foster parents, and non-birthing partners, leave policies sometimes differ significantly from those available to birthing parents — it's worth confirming explicitly what applies to your specific family situation rather than assuming parity.
If your employer's policy feels unclear or you suspect it isn't being applied correctly, many regions have a labor department, ministry of labor, or equivalent agency that can clarify your legal rights — and in some cases, employee handbooks or union agreements provide protections beyond the legal minimum that are worth knowing about.
